DOJ Tells Supreme Court: Homeschool Persecution Not a Problem


The Romeike family fled Germany and applied for asylum in America in order to homeschool their children freely. The Supreme Court could decide by the end of the month whether to take their case. Read more about the Romeike family.

The United States Supreme Court has scheduled Romeike v. Holder for review conference February 21. It is expected that the court will rule on whether or not to take the case and issue its decision in its February 24 orders.

The Romeikes were granted asylum in 2010 by a federal immigration judge who found that Germany’s treatment of the family amounted to persecution. As evidence he cited state officials’ threats against homeschoolers in general to levy crushing fines, file criminal charges, and take away children, and against the Romeikes in particular for their sincere religious beliefs.

The Obama administration appealed and has subsequently opposed granting the family asylum protection. The 6th Circuit Court agreed with the Obama administration, saying that Germany was just enforcing its law.

After he initially declined to reply to the Romeikes’ original petition, the Supreme Court ordered U.S. Attorney General Eric Holder to respond. In the response, Department of Justice lawyers argued that Germany wasn’t persecuting homeschoolers, just enforcing laws that apply to everyone. Germany has good reasons, say the department’s lawyers, for not allowing homeschooling. Germany’s desire to “promote socialization, pluralism, tolerance and democracy” outweigh the human rights of parents to decide how their children are educated. The department’s lawyers pointed to the infamous European Court of Human Rights decision that accepted Germany’s intolerance of homeschooling as a reason the Supreme Court should not get involved.

Grave Injustice

HSLDA Founder and Chairman Michael Farris is the principle author of the brief. He said that the Supreme Court should hear the case primarily in order to right a grave injustice, but also because our own federal circuit courts are confused on the issue of what legal standard to use when determining if prosecution can become persecution.

“The Supreme Court should intervene to settle the law in the federal circuits, which are in a state of chaos over how to decide when a foreign law is used to persecute people who act on the basis of their religion, like the Romeikes,” Farris said. “The Sixth Circuit’s decision perverted congressional intent of asylum law and used it as a sword against the Romeikes. This is an absurdity that we hope the Supreme Court will overturn.”

The 6th Circuit panel of judges ruled in April 2012 that Germany’s prosecution and harsh treatment of homeschool parents was merely law enforcement action that applied “equally” to everyone and did not on its face target people protected by asylum law. The court lifted a legal standard articulated in a 1993 Supreme Court case called Smith v. Employment Division.

The landmark Smith case changed the way the Supreme Court reviewed religious freedom cases. In Smith, the court ruled that it would not look at individual challenges to laws on religious grounds if the challenged law did not discriminate against a religious group on its face and if the law was generally applicable—meaning that it applied to everyone. However, the Supreme Court used this standard in the context of reviewing domestic government entities. There is no indication the standard was ever intended to apply to judging whether foreign governments were persecuting their own people.

“Appalling”

HSLDA Director for International Affairs Michael Donnelly was critical of the 6th Circuit ruling.

“It is appalling that three American judges ignored critical evidence from Germany’s own Supreme Court which explicitly states German states may treat religiously or philosophically motivated homeschooling parents unequally and harshly,” he said. “The recent story of the Wunderlich family, whose children were seized just because of homeschooling and who are now effectively imprisoned in Germany, demonstrates how important this issue is. The fact that our own government is unwilling to support asylum for these families is troubling.”

The right of parents to decide how their children are educated is enshrined as among the most fundamental human rights. Nearly a dozen major human rights documents and treaties, including the 1948 Universal Declaration on Human Rights, recognize how important the role of parental decision-making is in the education of children and that free governments must recognize and respect this important right.

Dark History

In a recent visit to Patrick Henry College, Professor Thomas Schirrmacher, ambassador for human rights with the World Evangelical Alliance and director of the International Institute for Religious Freedom, lectured on the issue. Based in Bonn, Germany, Professor Schirrmacher has been a longtime proponent of homeschooling freedom in Germany, writing and publishing several books on the subject. He explained that laws which depart from internationally recognized human rights standards are not a legitimate excuse for authorities to violate the rights of the people within their jurisdiction.

“The fact that the laws of a nation make something lawful doesn’t make it right,” he said. “Everything Hitler did in Germany was allowed by the law. He never moved until the law allowed him. Applying the national law of Germany at the time you couldn’t have convicted Hitler of a crime. But what he did obviously and dramatically was a crime against humanity.”

Schirrmacher, who has conducted extensive research on the issue, indicated that the effective ban on elective home education was introduced by Hitler in 1938.

“In 1938 the National Socialists passed a law making it a criminal offense if parents did not send their children to their schools,” he said. “These laws were never changed after the war in order to allow for homeschooling which had been possible before. I believe German leaders should take action to protect the right of parents to educate their children at home.”

New Zealand is no better. Our Country refused asylum to a German home educating family at the end of 2012. This family had been home educating in New Zealand for 5 years. They have now been forced to go back to Germany.

National Week of Prayer for Homeschoolers

It is National Week of prayer for homeschoolers in the USA this week.

I think it would be great if we join them and pray for home educators in New Zealand as well. (Since we are beginning a bit late we will use their week – next year we will begin on the Sunday the first day of the week not on Monday). This is a great week for us to be praying in since it is the beginning of our School year.

Pray for these men as they carry such an important responsibility for the spiritual care and physical provision of their families. Pray for protection of marriages.

Tuesday:  Pray for Homeschooling Moms
Please pray for homeschooling mothers to walk generously in the fruit of the Spirit. Pray that every moment in their day would be filled with much rejoicing and gentleness. Pray for their hearts to be encouraged as they fill so many different roles in their family, church, and community. Pray for their minds to be focused on the Lord and that they will trust everything to Him, not giving place to comparisons. Pray for protection of marriages.

Philippians 4:4-7 ~ Rejoice in the Lord always. Again I will say, rejoice! Let your gentleness be known to all men. The Lord is at hand. Be anxious for nothing, but in everything by prayer and supplication, with thanksgiving, let your requests be made known to God; and the peace of God, which surpasses all understanding, will guard your hearts and minds through Christ Jesus.

Wednesday:   Pray for Children at Home
Please pray for the children that are being educated at home to come to faith in Christ, walking out personal and deep relationships with the Lord. Pray for their minds to be saturated with the things of God and that their hearts would be set aside for His glory and work. Pray for relationships with parents to be solid, strong and healthy.

Isaiah 54:13 ~ All your children shall be taught by the Lord, and great shall be the peace of your children.

Thursday:  Pray for Graduates of All Ages
Please pray for those children who have graduated from homeschools. Pray that the truths of the Word will accomplish the purposes of God in their lives. Pray for clarity of thought as they build their own families and careers. Pray for strong relationships with parents and healing of any broken relationships within their families.

Philippians 4:1 ~ Therefore, my beloved and longed-for brethren, my joy and crown, so stand fast in the Lord, beloved.

Friday:  Pray for Second Generation Homeschoolers
Please pray for second generation homeschoolers who are discipling and educating their own children at home. Pray for these families to create their own traditions and learning environments while building on the good things their parents did. Pray for them to stand firm in their convictions and follow the Lord in all things.

Psalm 78:6 ~ That the generation to come might know them [laws of God], the children who would be born, that they may arise and declare them to their children that they may set their hope in God and not forget the works of God, but keep His commandments.

Saturday: Pray for Homeschooling Grandparents
Please pray for grandparents of homeschooled children to be encouraging towards the efforts of their adult children to disciple and educate the grandchildren at home. Pray for them to have wisdom on how to speak into their adult children’s lives when needed and how to help facilitate the vision of homeschooling. Pray for them to have great influence for good in the lives of their grandchildren, always pointing them to Jesus.

Psalm 145:4 ~ One generation shall praise Your works to another, and shall declare Your mighty acts.

Sunday: Pray for Revival in the Homeschool Family
Please pray for the Holy Spirit to do a mighty work in homeschooling families across the world. Pray for hearts to be humbled and submitted to the Lord. Pray for true repentance and turning from sin. Pray for entire families to seek the face of God together, crying out for His presence in their homes. Pray for a harvest of souls through the witness of the power of the Holy Spirit in the lives of homeschoolers.

Judge Rebuilds “Berlin Wall” Just for Homeschoolers

Judge Calls Homeschooling Abusive “Straitjacket”


Following 21 days in German state custody, the four Wunderlich children were reunited with their parents, Dirk and Petra, in September. But now a family court judge refuses to return legal custody of the children to the parents. Read more about the Wunderlich family.

Following a hearing on December 18, 2013, in Darmstadt, Germany, Family Court Judge Marcus Malkmus slammed the door on the Wunderlich family’s emigration hopes. Lawyers for Dirk, Petra, and their children had asked the judge to return legal custody to the parents because they have complied with court orders that the children go to school and because they wish to move to France where homeschooling is legal.

In August 2013 the four Wunderlich children were seized in a raid by 20 police officers and social workers simply because they were being homeschooled, an activity that is illegal in Germany. After an international outcry, the children were returned three weeks later on the condition that the parents send them to public school. Testing conducted on the children during their stay in a group home indicated that they were well adjusted, social, and academically proficient.

In Malkmus’s written order, (an unofficial English translation is avalaible here) he compared homeschooling to a straitjacket for children. While acknowledging that the Wunderlich children were well cared for and did not have educational deficiencies, he refused to return legal custody to the parents.

He said it was necessary to keep the Wunderlich children in German public schools to make sure that they were integrated into society. If they were allowed to be homeschooled in Germany or anywhere else, the consequences might be that “the children would grow up in a parallel society without having learned to be integrated or to have a dialogue with those who think differently and facing them in the sense of practicing tolerance.” Malkmus also wrote that homeschooling creates “concrete endangerment to the wellbeing of the child.”

“A Human Right”

Dirk Wunderlich told Home School Legal Defense Association that he was shocked by the harshness of the decision: “I had really hoped the judge would just let us leave Germany peacefully. We don’t isolate our children. They are well adjusted and doing well academically. We are happy for them to be connected to society. We just prefer to homeschool them because we believe it is better for them. It is so sad that my countrymen are not able to see that homeschooling should be allowed. It is legal in many other countries, and I believe is a human right.”

“Judge Malkmus has erected another Berlin Wall apparently designed to prevent all parents who might leave to homeschool from leaving Germany. This is no different than what happened in the former East Germany under communism and before that under the Third Reich,” he continued. “We need help from others around the world to help our country see this terrible violation of human rights.”
