Changes to the Education Act

My internet is too slow at the moment so I can’t get into this link on my computer. From beginning to read the link, on my phone, it looks like we may have to do some lobbying over the proposed changes in the Education Act.

The first thing that I have noticed is that once a 5 year old begins school – school will be compulsory from the day that they first attend school.

“While children were able to start on their 5th birthday, the Act could be changed to make attendance compulsory once they did start, instead of from the age of 6.”

We often get inquiries from those parents whose 5 year olds are at school and they realise that school is not working for their child and want to home educate. Easy we say just pull your child out of school and begin home educating them. THEN begin filling out an application form to home educate them. You have up until they turn 6 to apply for the exemption.

If the law is changed then the family would have to leave their child in school until they get an exemption or go through the hoops to get a justified abense.

I still need to take a look at the proposed changes.

The proposed timeline for the changes to the Education Act at this stage:

“Public consultation opened on Monday and would run until December 14.

“The outcome would become known in early 2016, before a Bill was drafted and introduced to Parliament.”

Needing information

I have been home educating with an exemption for 29 years. Craig and I have had contact with the MoE for most of those years. I have to say that the current staff at the National Office of the MoE are the most home educating friendly National Office staff that we have had. We have seen them making changes to make the enviroment for home educating in New Zealand even better than it already was.

At the moment we are going through the Red Tape Cluster Buster meeting results and the Survey that many of you filled out. On many of the comments that you all made the MoE is listening and making changes. Hopefully we will be seeing the plain english version of the Exemption Form by the end of June.

There are some things that the MoE have discussed and decided to make no changes on. I would like to mention two of those things here and get your feedback where appropriate.

 

School Principals

The MoE still feels it needs to talk with the Principals during the exemption application process when we are pulling our children out of school to home educate them.  They did say to us in one meeting that if people are having trouble with their principal during the exemption application process then we need to let them know. Today I have just heard of two families having trouble with their principal during the application process.

If you have had or are having  any trouble with your principal due to the MoE contacting them during the exemption application process then please let me know.

 

Justified Absence

The same applies to “Justified Absence”. I thought that we might be able to use the term “Justified Absence” which schools have to justify why they are not at school for a period of time but the MoE is keeping to their decision that our children must be in school during the ages of 6-16 unless they already have an exemption.

So if you are having any a trouble getting a “Justified Absence” from your principal, a letter from your Dr or any other way then please let me know.

I still don’t have the internet on. This post has been written in a hurry as we are going out shortly to hopefully buy a car and see again about getting the internet at our new home. I want to hear from you as soon as possible so that we can talk to the MoE about this as soon as possible.

MoE Accepting Applications from Age 5

This afternoon I receive and email from Lucy Ambrose from the National Office about the process of getting an exemption for our nearly 6 year olds. Lucy’s email is about a policy change and is a direct result of the Scoping Survey that was done last year.

Hi Barbara and Meredith,

As you will remember, we agreed to look into the age that a child must be before parents can apply for a long-term exemption from enrolment. We have now reached an in-principle agreement that we will be able to accept applications following the child’s fifth birthday (as opposed to the current six weeks before their sixth birthday).

The law remains the same, however – the exemption begins at the sixth birthday, but this change will allow the Ministry to process applications before these children are obliged to enrol in a school. This will reduce disruption to home education parents, students and schools.

This will take effect from 1 June 2015, absent major technical challenges.

We are having a hui with our regional home education staff on 11-12 May, and will brief them about this change. At this meeting, we also intend to train our staff in a range of home education philosophies, and the benefits of each.

We will also put a note on our website regarding this change.

Ministry of Education – Review report and Ministry work programme

The Ministry of Education has recently completed its review of home education in New Zealand which we consulted with you on in September 2014. We have now developed a work programme for change which includes a number of operational improvements.

As well as consulting with you, we also sought feedback from Te Aho o Te Kura Pounamu (the Correspondence School) and the Education Review Office (ERO) as well as Ministry of Education staff. We used the feedback from throughout the sector to inform our decisions and actions to improve home education in New Zealand.

The report contains the Ministry’s future work programme for home education as an appendix and includes dates about when particular changes are scheduled to take place.

These changes are mainly focused on operational improvements including:

·         Reviewing the application form and appeal and complaints process

·         Developing new practice guidelines

·         Training ministry advisors in home education philosophies

·         Implementing a more robust application assessment process (in particular regarding declining applications)

We have also made some immediate improvements based on your feedback. For example the Statutory Declarations will no longer need to be signed by a Justice of the Peace which will take effect 1 April 2015.

School has begun and I don’t have my exemption yet

A new school year and a lot of people have exemption applications into the MoE and have not heard back yet. What should they do?

This is a problem at the moment especially in the Auckland office where they have a lot of exemption applications to process.

Keep your children at home. Even though any contact with the MoE will say that your children must be in school until you get your exemption – the MoE have to say that because that is the law. Schools have a number of excuses for pupils not to be in school when they should be and they have policy to cover that called “Justified Absence”.  So we have asked the MoE to make applying for an exemption to be able to come under “Justified Absence”. That should be happening probably later this year. In the meantime there are ways to keep our children out of school under “Justified Absence”: https://hef.org.nz/getting-started-2/truancy-and-the-home-schoolerhome-educator/

The MoE used to be very  strict on this saying that our children must be in school until we got our exemptions BUT they are a lot more tolerant these days to the “Justified absence” ideas that are in the link above. Hopefully soon we will have no more hoops to jump through on that and it will be a matter of course. Then they will be able to write in the letters to us, when asking more questions, that “Justfiied Absence while getting an exemption” is their policy. It isn’t at the moment. So while people are waiting for their exemption to come through here are some ideas of what to do:

1. Wait.

2. Don’t send your child/ren to school

3. Ring the MoE and see what the status of your exemption application is.

4. Wait some more and keep your children out of the public during school hours (only until you get your exemption)

5. You are 99.9% sure of eventually getting your exemption so begin home educating your child as you have planned.

IMG_86036. Your child can be out of school for 20 consecutive days before the truancy officer is informed. Your child can go to school for one day then have another 20 consecutive days off school etc.

7. If the Truancy officer or a school contacts you, after the 20 days, tell them that you are waiting on your exemption and that you are heading to the Dr for a letter of explanation for why your child is out of school or

8. Enrol your child/ren at another school but don’t send them to it.

This will buy you some time until you get your exemption.
